Labour Market Impact Assessment (LMIA)
LMIA: Empowering Your Business with Global Talent!
What is LMIA?
A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada needs to hire a foreign worker who does not have a work permit to work in Canada. The LMIA is issued by Employment and Social Development Canada (ESDC) and assesses the impact of hiring a foreign worker on the Canadian job market.
If an employer is looking to hire a worker from abroad and the LMIA is positive, it means that hiring the foreign worker will not negatively affect the job opportunities of Canadian citizens or permanent residents. A positive LMIA is often a key step in hiring a foreign worker and it allows the worker to apply for a work permit.
Whether you are an employer seeking to hire international talent, or a skilled worker aiming for a job opportunity in Canada, LMIA plays a critical role in the process.
Eligibility
The employer in Canada will be assessed against the LMIA requirements only. The foreign national is not involved in the LMIA process and his/her factors will not be considered in the approval or refusal of an LMIA request.
- Employer Requirements:
- To apply for the LMIA, employers must provide necessary documentation with their application to establish that their business and job offer are genuine.
- The employer must prove they have made sufficient efforts to hire a Canadian worker first.
- The job offer must be real and the pay amount should be at the median wage for the position or higher.
- Employers need to meet all relevant provincial and federal regulations regarding wages, working conditions, and employee benefits.
The foreign worker needs to meet specific requirements to be approved for the work permit as well :
- Foreign Worker Requirements:
- A job offer from an employer with a positive LMIA.
- Relevant qualifications and work experience for the job.
- Language proficiency and education may be required, depending on the role.
- Ability to demonstrate the intention to leave Canada at the end of the work permit term, unless applying for permanent residence.
How the LMIA Process Works?
Employer Applies for LMIA: The Canadian employer submits an application to ESDC, providing details about the job offer and the efforts made to recruit Canadian workers.
Labour Market Assessment: ESDC reviews the employer’s application to determine if hiring a foreign worker is justified. If the employer meets the criteria, a positive LMIA will be issued.
Foreign Worker Applies for a Work Permit: Once the LMIA is approved, the foreign worker can apply for a work permit with the LMIA approval letter. This is the final step to legally work in Canada.
Work Permit Issued: If the work permit is approved, the foreign worker can begin employment in Canada.
